Convicted in Florida for Driving Under the Influence
Florida has very strict penalties and punishment for people who are convicted of driving under the influence. According to Florida Statutes 316.193, “a person is guilty of the offense of driving under the influence and is subject to punishment if the person is driving or in actual physical control of a vehicle within this state. The person is under the influence of alcoholic beverages, any chemical substances or any substance controlled when affected to the extent that the person’s normal faculties are impaired.”
The blood alcohol limit for a DUI in Florida is .02% for a person under the age of 21, .08% for a person 21 or older, and .04% for commercial. If a person is arrested and charged with DUI he faces jail time, fines and penalties, license suspension, and an interlock ignition device if convicted. A 1st offense can include up to 6 months in jail, a fine of between $500.00 and $2,000.00, a license suspended for 180 days to a year. A 2nd offense ups the jail time to 9 months, fines and penalties from $1,000.00 to $4,000.00, and a license suspension of up to 5 years. A 3rd offense could result in 30 days to 5 years in jail, a fine and penalty of $2000.00 to $5,000.00, and a license suspension on up to 10 years. All drivers could have an interlock ignition device installed on their cars. If there is an injury or death involved due to driving under the influence, then the fines and penalties could increase.
